Get three answers in writing before a client is on the recording: whether your content is used to train models, how long audio and transcripts are retained and whether you can set retention to zero, and whether there is a SOC 2 Type II report you can actually read rather than a badge on a website. Otter has drawn consent litigation over recordings, which is the shape of the risk here.

How consent is handled. Around a dozen states, including California, Florida, Pennsylvania and Massachusetts, require every party to consent before a conversation is recorded, and no jurisdiction treats a bot showing up in the participant list as consent. Do I need client consent to record a meeting with an AI notetaker?

In roughly a dozen states, including California, Florida, Pennsylvania and Massachusetts, every party to the conversation must consent before it is recorded, and the safest practice is to treat all-party consent as your standard since you rarely know where everyone is sitting. A bot visible in the participant list is not legally sufficient notice. What happens to client data in an AI meeting assistant?

Is an AI meeting assistant worth it for a compliance-only tax practice?

Usually not on time savings alone, because a practice built on drop-offs, portals and a short January call does not generate enough meeting volume to pay for it. The case is stronger where meetings carry risk rather than volume: tax planning conversations, a client instructing you to take an aggressive position, or a scope conversation that later gets disputed.
